Dulaney v. Packaging Corp. of America, No. 10-2316

The Fourth Circuit Court of Appeals found genuine issues of material fact in dispute as to Carla Dulaney’s claims of sexual harassment in violation of Title VII. Because there was a genuine issue of fact as to whether Packaging Corporation of America took “tangible employment action” against Dulaney, the Court vacated and remanded the district court’s grant of summary judgment in favor of Packaging Corporation of America.
