United States v. Oceanpro Industries, Ltd., No. 10-5239

Oceanpro Industries, Ltd., a seafood wholesaler in D.C., and two Oceanpro employees were convicted for purchasing untagged and oversized striped bass in violation of the Lacey Act. Oceanpro and one employee were also convicted for giving a false statement to federal law enforcement officers during the course of the investigation of the crimes. On appeal, defendants challenge the District of Maryland’s venue for the false statement offense because the false statement was made in the District of Columbia. In addition, the defendants contended that the order of restitution to the States of Virginia and Maryland was improper because the States did not have a sufficient interest in the illegally caught fish so as to make them “victims.” The Fourth Circuit Court of Appeals rejected both arguments and affirmed the judgment of the district court.
