United States v. Strieper, No. 10-5060

Decided: January 23, 2012

The Fourth Circuit affirmed application of two five-level enhancements to Alan Paul Strieper’s sentence for attempted enticement, receipt of child pornography, and possession of child pornography, and held that his sentence of 420 months was substantively reasonable. The court held that for purposes of Sentencing Guideline § 2G2.2, the term “minor” may include an unidentified individual, provided that evidence shows the individual would be under eighteen years of age.
